2. General provisions

The General Terms and Conditions of  the https://www.tawel.si, www.tawel.eu online store (hereinafter: the online store and the website) are drawn up in accordance with the Consumer Protection Act (ZVPot), the Consumer Protection against Unfair Commercial Practices Act (ZVPNPP), the Electronic Commerce on the Market Act (ZEPT) and international codes for e-commerce.

An online store is a sales system designed to present and sell products to the user. It is managed by Inovika d.o.o. (hereinafter: the provider). A user is a person who uses the system, i.e. a buyer in the online store (hereinafter: the customer). The General Terms and Conditions deal with the operation of the online store, the rights of the user and the business relationship between the provider and the user.

The content accessible to the users of this website are creations protected as copyrighted works in accordance with the provisions of the Copyright and Related Rights Act (ZASP) and other applicable regulations. The holder of copyright and any other rights to the said copyright works is the provider. Without the express written permission of the provider, the users of the website are not allowed to reproduce, distribute, transmit, play, display or otherwise publicly communicate the copyrighted works contained on this website.

3. Protection of personal data

The provider undertakes to permanently protect all personal data of the buyer that he entered at the time of purchase (name, surname, address, postal code and mail, telephone, e-mail address), and we keep documentation of communication with him. The provider uses personal data about the customer exclusively for the purpose of fulfilling the order (sending e-news, offers, pro forma invoices, invoices, etc.) and other necessary communication. In no case does the provider hand over the data about the buyer to unauthorized or third parties.

If the buyer (user) wants to edit or delete his data from the provider's list, he can notify him to the e-mail address: sales@tawel.si or send a written request via regular mail to the address: INOVIKA d.o.o., Študljanska 38, 1230 Domžale.

4. Prices

All product prices are clearly displayed, and in all given product prices, if charged, value added tax is already included. The provider reserves the right to make daily price changes, unless otherwise stated. The prices listed on the website do not include the cost of postage.

The prices are valid at the time of placing the order and do not have a predetermined validity. Prices apply in the case of payment using the above payment methods under these General Terms and Conditions.

5. Products & Photos

Due to the nature of online business, the product range is updated and changed frequently and quickly. In order to present the basic characteristics of the sales products listed on the product packaging, the provider strives to provide clear and complete salesrmation. Products are constantly redesigned (updating the formulation, changing the packaging) so that the content and ingredients of the product can change. The provider tries to make the sales about the products as accurate as possible and that they are constantly updated. It may happen that some mandatory salesrmation, list of ingredients, quantity, etc., change from time to time. On the product received by the buyer, all mandatory information is indicated.

The provider recommends that customers always carefully read the sales information provided by the manufacturer of the product on the product packaging or label with the declaration before using the product. Product sales are provided for personal use only and may not be reproduced or exploited in any way without the prior consent of the provider. The provider reserves the right to make content and other changes in the online store without prior notice.

All photos are purely symbolic and do not guarantee the properties of the product. The colour shades and appearance of the products may differ from the actual condition of the products, which does not affect the definition and standard of the product. The provider does not accept responsibility for any minimal differences between products and display in the online store. Textual errors are possible and the provider does not take responsibility for them, which does not affect the legal rights of the buyer.

6. Purchase process

The buyer selects the type and quantity of the product, if available, as well as additional properties (e.g. shade). Before placing an order, he inspects the shopping cart, makes any corrections or proceeds with the purchase and confirms the order. This is followed by an online form in which the buyer enters all the necessary information for the delivery of this product. After the order has been placed, changes are no longer possible, the buyer is sent a notification of the purchase by e-mail to the e-mail address provided during the purchase. In the event that the buyer has chosen to pay by pro forma invoice, the information for payment to the provider's transaction account will also be displayed on the notification.

The ordered products are delivered by the provider in accordance with the conditions from the Delivery sector.

7. Technical means for identifying and correcting errors before the award of the contract

Before completing and placing the order, the buyer is allowed to:

  • sees and reviews which products they have selected and added to the cart,
  • sees and reviews the price of an individual product and the total price of the entire selected quantity of each product,
  • the price and quantity of all selected products,
  • changes the quantity of selected products,
  • remove products from the cart,
  • verifies and changes the entered data,
  • Changes the delivery/delivery method.
  • Changes the method of payment.

INOVIKA d.o.o., as the provider, sends a confirmation of receipt of the order to the e-mail address of the buyer provided by him.

If the buyer does not want to place the order, he can leave the online store before placing the order.

8. Payment method

The buyer can pay his order:

  • by bank transfer
  • via PayPal account
  • by credit card through integrated payment

Payment via PayPal

The buyer pays directly through his PayPal account. After placing the order, he will be redirected to PayPal, where he confirms the value of the order. As soon as the customer's PayPal account is debited, the customer is redirected back to the store, where the payment and order status are displayed. The PayPal account is charged for the actual invoice amount. If the payment via PayPal is not successful, but the order is successfully placed, the buyer can contact the provider at the address sales@tawel.si and ask for help with payment or for a change in the payment method.

9. Delivery

The delivery of all orders placed in the online store is handled by General Logistics Systems, logical services, d.o.o., Cesta v Prod 84, 1129 Ljubljana (hereinafter: GLS Slovenia), VAT ID: SI74531891, registration number: 1538217. The goods ordered in the online store will be handed over by the provider to GLS Slovenia for delivery to the address specified during the purchase in the online store within three working days. If this is not possible due to special circumstances, the provider will notify the customer via the e-mail address provided by the customer when filling out the online form in the online store and try to reach an appropriate agreement with him. GLS Slovenia delivers in accordance with its own business policy.

Notwithstanding the first and second paragraphs of this sector, the provider may also deliver orders in its own implementation, if it is reasonable to do so due to the nature of the business, and through GLS Slovenia, if required by special conditions.

The Provider delivers the goods to the address provided by the Buyer when filling out the online form in the Online Store. In the case of personal pick-up, the provider agrees on the exact time and place of pick-up with the buyer by establishing contact via the e-mail address or phone number of the buyer provided when filling out the online form in the online store.

Price of delivery of goods in the territory of the Republic of Slovenia: 2,90 EUR.

If the value of the purchase is 80,00 euros or more, delivery is free of charge for all EU countries.

10. Right of withdrawal, return of goods, refund of payment

The buyer has the right of withdrawal within 14 days of receiving the goods. Withdrawal must be sent to sales@tawel.si or in writing to the address INOVIKA d.o.o., Študljanska cesta 38, 1230 Domžale. Buyer must state, that he or she is withdrawing from the contract or order, without having to state the reason for his decision.

The buyer who withdraws from the purchase in writing may make a statement of withdrawal from the purchase on the Form for exercising the consumer's right to withdraw from the contract, which can be found in these General Terms and Conditions. If the buyer has already received the goods and withdraws from the contract, he must send the goods unused, unwashed and undamaged to the provider within 14 days after the message that he withdraws from the contract. The only cost charged to the buyer in connection with the withdrawal from the contract is the cost of returning the products.

The buyer must return the received goods undamaged, unwashed and in an unchanged form and quantity, unless the goods are damaged without the fault of the buyer.

The buyer can inform the provider how the paid purchase price and any shipping costs should be refunded. If they fail to do so, the provider will refund the purchase price paid and any shipping costs in the same way as they were charged.

The provider shall immediately or within 14 days from the day on which the buyer has notified the provider of the withdrawal from the purchase, refund the purchase price by transfer to the buyer's bank account.

11. Factual errors

The buyer may exercise his rights due to a material defect if he notifies the provider of the defect within two months from the day on which the defect was discovered. The buyer must describe the defect in detail in the error notification and allow the seller to inspect the matter.

The provider is not responsible for material defects in the goods that appear after two years have passed since the item was handed over. A defect in a thing is considered to have existed at the time of extradition if it occurs within six months of extradition.

The buyer, who correctly informed the seller of the defect, has the right to demand from the provider to eliminate the defect in the goods or return part of the amount paid in proportion to the defect or replace the defective goods with a new defective one or return the amount paid.

12. Complaints and out-of-court settlement of consumer disputes

The provider does not recognize any provider of out-of-court settlement of consumer disputes as competent to resolve a consumer dispute that the customer could initiate in accordance with the Out-of-Court Settlement of Consumer Disputes Act (ZIsRPS).

13. Retention of the contract and the language of the contract

Purchase contracts (orders) are concluded in the Slovenian language and are stored in electronic form. After placing the order, the customer receives the purchase contract to the e-mail address provided in the order form. Contracts are also available at a later date:

For registered buyers: via a user account or upon written request by e-mail to the sales@tawel.si

For unregistered buyers: upon written request by e-mail to the sales@tawel.si

14. Subscribe to the newsletter

By subscribing to the e-newsletter, the user agrees that the personal data provided when subscribing to the e-newsletter are used or processed for the purpose of forwarding messages related to the provider's business (campaigns, news, advertising messages, news, etc.) to the provider's e-mail address.
